MOMENTUM TERMS

Clear expectations for using and participating in Momentum.

These terms set the general rules for Momentum applications, digital services and participation. A specific offer, pilot agreement or organisation contract may add commercial or programme terms for a particular relationship.

Built around responsibility

Momentum provides a structured developmental environment. Participants remain responsible for their decisions and actions, Guides retain defined human authority within the programme, and sponsoring organisations do not own an individual’s private development record.

Scope

These terms apply when you access Momentum™ websites or digital services, submit an application, create an account or participate in a Momentum programme. By using the relevant service or accepting the applicable acknowledgement, you agree to the terms that apply to that activity.

Momentum may also issue a specific invitation, commercial offer, cohort agreement, pilot agreement or other written terms. Where those specific terms address the same subject differently, the specific written terms take priority for that relationship.

Applications and invitations

Submitting an application does not guarantee acceptance, an invitation, a place in a programme or any particular commercial offer. Momentum may review the information provided and decide the appropriate next step.

You agree to provide information that is accurate to the best of your knowledge and not deliberately misleading. Momentum applications are designed to help create useful developmental context as well as support an admission decision.

An applicant account may be created or invited before paid participation begins. An applicant account is not the same as an active Builder entitlement.

Participation

Momentum works through reflection, assessment, Development Priorities, Meaningful Action, evidence and review. The value of the process depends partly on the participant engaging honestly and taking responsibility for their own actions.

Participants are expected to use the service respectfully, attend or prepare for agreed Guide interactions where reasonably possible, submit relevant progress information honestly and avoid intentionally disrupting the experience of others.

Momentum does not promise a particular personal, health, employment or business outcome. Development is influenced by the participant’s circumstances, decisions, engagement and factors outside Momentum’s control.

Organisation-funded places

An organisation may fund or sponsor an individual’s participation. Sponsorship is a funding and access relationship; it does not make the organisation the owner of the participant’s identity, private assessment detail, Guide conversations or developmental history.

Momentum may provide the sponsoring organisation with information that has been agreed as organisation-permitted reporting, such as appropriate participation, completion, cohort-level movement or non-identifying themes. The applicable privacy notice explains this boundary in more detail.

If sponsorship ends, access funded by the organisation may end or change. Momentum may, where appropriate, offer the individual a separate continuation route. Any continuation will be governed by its own commercial terms.

Fees and commercial terms

Prices, minimum terms, payment dates, cancellation arrangements and any organisation-specific scope will be set out in the relevant invitation, checkout, proposal, order, pilot agreement or contract.

Where an organisation pays for a cohort, the organisation’s agreement governs its payment obligations. Where an individual pays directly, the individual commercial offer governs their payment obligations. A failed, reversed or cancelled payment may affect paid programme access in accordance with those specific terms and applicable law.

Nothing in these general terms removes statutory consumer rights that cannot lawfully be excluded.

Developmental scope

Momentum is a performance and development system. It is not an emergency service and does not provide medical diagnosis, psychotherapy, regulated financial advice or legal advice.

Physical, mental and relationship performance may form part of developmental reflection, but participants remain responsible for seeking appropriately qualified professional help where a matter requires clinical, medical, legal, financial or other regulated expertise.

If you believe you or someone else is in immediate danger or experiencing an emergency, use the appropriate emergency or professional service rather than relying on Momentum.

Accounts and acceptable use

You are responsible for keeping your login credentials secure and for activity carried out through your account unless you have reported unauthorised access. Tell Momentum promptly if you believe your account has been compromised.

You must not attempt to access another person’s private record, bypass security controls, interfere with the service, introduce malicious code, scrape protected information, impersonate another person or use Momentum unlawfully.

We may restrict access where reasonably necessary to protect participants, data, intellectual property, service security or legal compliance.

Intellectual property

Momentum materials, frameworks, programme structures, assessments, reports, written content, designs, branding and other proprietary materials remain owned by or licensed to Momentum and its relevant rights holders.

Participation gives you a personal, limited right to use materials supplied to you for the purpose for which they were provided. It does not grant permission to reproduce, sell, publish, license, train competing systems on, or commercially exploit Momentum materials without written permission.

You retain ownership of original information and material you provide. You give Momentum the rights reasonably necessary to process that material to provide, administer and improve the service in accordance with the privacy notice and applicable law.

Ending participation

A participant may choose to stop engaging with Momentum, subject to any payment or minimum-term commitments in their specific commercial agreement. Momentum may suspend or end access where there is a serious or repeated breach of these terms, misuse of the service, non-payment under an applicable agreement, or a safety/security reason that makes continued access inappropriate.

Ending participation does not automatically require immediate deletion of every record. Some information may need to be retained for legal, accounting, security, dispute or legitimate programme-record purposes as described in the privacy notice.

Responsibility and liability

Momentum will provide its services with reasonable care and skill. Participants remain responsible for decisions they make and actions they take as a result of reflection, discussion, reports or programme activity.

To the fullest extent permitted by law, Momentum is not responsible for losses caused by matters outside its reasonable control or by a participant acting contrary to professional advice, programme guidance or these terms. Nothing in these terms excludes or limits liability where it would be unlawful to do so.

Digital services can occasionally be unavailable because of maintenance, supplier failure, security work or technical events. We will take reasonable steps to restore service but do not promise uninterrupted availability.

Changes and contact

Momentum may update these terms as the service develops or where law, technology or programme architecture changes. Where a change materially affects an existing participant relationship, we will provide appropriate notice where required.

These terms are intended to operate under the laws applicable to Momentum’s UK operations. Any mandatory rights or jurisdiction rules that apply to you remain unaffected.
